Agreement
These terms are an agreement between you and PrequalFunnel ("PrequalFunnel", "we", "us"). By creating an account, starting a trial or using the website or app, you accept them. If you use PrequalFunnel for a company, you confirm that you can bind that company, and "you" means the company. If you do not agree, do not use the service.
The service
PrequalFunnel provides embeddable US mortgage and loan calculators, themes and widgets, a lead form, a built-in CRM, email lead alerts, lead webhooks, custom domains and white-label options, depending on your plan. We may improve, change or retire features over time. We will give reasonable notice before removing anything material to a paid plan.
Accounts and seats
You must give accurate information when you register and keep it current. Keep your credentials private and turn on two-factor authentication. You are responsible for activity in your account and for the teammates you invite, within your plan's seat limit. Tell us promptly at [email protected] if you suspect unauthorized access.
Plans, trials and billing
- Originator is free and has the limits shown on the pricing page.
- Trials. Producer and Brokerage include a free trial on monthly and yearly billing for the length shown at sign-up. If you do not cancel before the trial ends, the paid plan starts and you are charged.
- Subscriptions billed monthly or yearly renew automatically at the end of each period until you cancel.
- Lifetime plans are a one-time payment for continued access to that plan's features for as long as we operate PrequalFunnel, subject to these terms and fair use.
- Payments are processed by Stripe. Prices are in US dollars and exclude applicable taxes.
- We may change prices for future billing periods with at least 30 days' notice. Changes never apply to a period you have already paid for.
- Cancellations and refunds are covered by our refund policy.
If a payment fails and is not resolved, we may move your workspace to the Originator plan's limits.
Acceptable use
You agree not to:
- use PrequalFunnel for unlawful, deceptive or discriminatory purposes, including steering borrowers based on a protected characteristic;
- call, text or email people without the consent the law requires;
- collect information you are not permitted to collect, or misrepresent what a calculator result means;
- attempt to breach security, overload the service, scrape it or interfere with other customers;
- reverse engineer the service except where the law expressly allows it; or
- resell access to PrequalFunnel as a standalone product. Using calculators on websites you operate for your own team or branches is fine.
Your content and your leads
You own the content you create and the leads your calculators capture. You give us permission to host, process and transmit that information only to provide the service to you. You are responsible for:
- having a lawful basis, and any consent the law requires, to collect and use lead information, including for calls and texts;
- the licensing information, NMLS ID, Equal Housing Opportunity statement, advertising disclosures and privacy notice on your websites;
- the wording you add to calculators and lead forms; and
- the destinations you send leads to with webhooks, and what those systems do with them.
Calculators produce estimates
Calculator results are estimates based on the inputs a person enters and on default assumptions. They are not offers of credit, loan commitments, pre-approvals, Loan Estimates or financial, tax or legal advice. Government figures are sourced and dated but can change. You are responsible for how calculators are presented on your sites. See our disclaimer.
Intellectual property
The service, the calculators, their formulas, designs and templates, and the PrequalFunnel name and marks belong to us or our licensors. While your account is in good standing, your plan gives you a limited, non-exclusive, non-transferable right to use the app and embed calculators on websites you control. Feedback you send us may be used without obligation to you.
Third-party services
PrequalFunnel connects to services you choose, such as HighLevel, Zapier, Make, your SMTP provider or your DNS host. Those services are governed by their own terms, and we are not responsible for them.
Suspension and termination
You can close your account at any time. We may suspend or end an account that breaches these terms, fails to pay, or puts the service, our customers or borrowers at risk; where practical we will give notice first. When an account ends, embeds and direct links stop working. Export your contacts before closing.
Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the service will be uninterrupted or error free or that it will produce any number of leads, applications or closed loans.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business. Our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
Indemnity
You will defend and indemnify us against third-party claims arising from your content, your leads, your websites, your communications with borrowers or your breach of these terms.
Governing law and disputes
These terms are governed by the laws of the State of Delaware and applicable US federal law, without regard to conflict-of-law rules. Before filing a claim, each side agrees to try to resolve the dispute informally for 30 days after written notice. Notices to us go to [email protected].
Changes to these terms
We will post updated terms on this page and change the date at the top. For material changes we will notify account holders in the app or by email before they take effect. Continuing to use PrequalFunnel after that means you accept the updated terms.
